Following a jury trial, Waters was convicted of possession with intent to distribute cocaine base in violation of 21 U.S.C. Â§ 841(a)(1) (1988) (Count I), carrying a firearm during and in relation to a drug trafficking crime in violation of 18 U.S.C. Â§ 924(c)(1) (West 1976 & Supp. 1992) (Count II), and aiding and abetting the making of false statements to a licensed firearms dealer in violation of 18 U.S.C. Â§ 2 (1988) and 18 U.S.C.A. Â§ 924(a)(1)(A) (West 1976 & Supp. 1992) (Count III). The district court sentenced Waters to terms of twentyseven months on each of Counts I and III to run concurrent with each other, and sixty months on Count II to run consecutive to the sentence imposed on Counts I and III. Waters timely appealed.
